Fraud Committed Against An Elderly Woman, EOW Filed A Case Against The Builder, The Court Reprimanded


Cheating a disabled person in Vasant Kunj area has cost the famous builder of the area, Shaili Thapar. About five months ago, the builder cheated a disabled senior citizen and his wife and got the property registered on an area of ​​about four thousand square meters. It is alleged that officials of the Revenue Department were also in connivance with the builder in this matter. Following the complaint of an elderly woman, the Economic Offences Branch of the Delhi Police has registered a case of cheating against builder Shaili Thapar, his son Sahir Thapar, his company RSS Estate, officers of the South District Sub-Registrar’s Office and others. On the other hand, the Delhi High Court has also directed the builder in this matter that he will not create any kind of hindrance in the movement of the victim’s family. Besides, interference of any third party in the disputed plot has also been prohibited.

This is how the suspicion of fraud arose

This whole matter is Gogiya Farm situated on Church Mall Road of Vasant Kunj. The owner of the farm, elderly Monica Gogia, had signed an agreement with builder Shaili Thapar to sell the four thousand square meter portion. As per the agreement, Thapar made an advance payment of Rs 10 crore towards this Rs 38 crore deal and promised to pay the remaining amount before registration. Thereafter, on February 23, Monica Gogia was taken to the office of the Sub-Registrar of Mehrauli and the documentary formalities were completed. Where Monica Gogia appeared before the sub-registrar and refused to give permission for registration until they paid the dues and returned home. After this, when she became suspicious, on February 27, she lodged a complaint with the office of Deputy Registrar Shobha Toula and DM M. Chaitanya Prasad and gave him complete information about the matter and asked him not to carry out the registration.

Serious accusations against the builder

It is alleged that Sub-Registrar Shobha Taula, accused of collusion in the case, conspired with accused builder Shaili Thapar and issued a notice to Gogiya giving him time to reply within three days. But this written notice on February 29 was sent to him on March 2. Thus, the role of the Sub-Registrar became clearly dubious. Monica Gogia alleges that she responded to the notice received on the evening of March 4 within the stipulated time, but the Registrar ignored all the facts and registered her property in the name of builder Shaili Thapar.

It is alleged that on March 8, builder Shaili Thapar along with around five dozen goons forcibly entered Gogiya farmhouse and illegally constructed a wall there and blocked their entry and exit. The victim appealed this matter before the Delhi High Court and on March 9, the court ordered the builder not to block the road to the victim’s family and not to carry out any kind of construction till the decision was taken.

Argument given in favor of registration carried out by mutual agreement

In this case, builder Shaili Thapar said that the agreement to buy the property for Rs 38 crore had expired on February 10, which the Thapar family itself had cancelled on March 2 through a public notice. Therefore, the issue of non-payment of the dues under that agreement is erroneous. He said that he had made two registrations for the 4,000-yard plot without any new agreement. This agreement and deal was made by mutual agreement between Gogiya and Thapar. When he was asked why and how can someone sell his property for Rs 10 crore within a month after the old agreement of Rs 38 crore. So he maintained that it is a case of registration made by mutual agreement.

The matter reached the Economic Crimes Section

Fed up with the connivance with Revenue Department officials and harassment by builder Shaili Thapar, the elderly woman complained about the matter to the Economic Offences Branch of the Delhi Police. They allege that builder Shaili Thapar and his son Sahir Thapar are land mafiosi and are also trying to grab the remaining property worth around Rs 95 crore. In this case, EOW has registered a case of fraud against builder Shaili Thapar and his son as well as officials of Sub-Registrar Hauz Khas. Delhi High Court judge Neena Bansal Krishna, who is hearing the case, on Monday ordered builder Shaili Thapar not to block the way of the victim’s family. It has also been ordered that till the decision of the case, no third party will be involved in the disputed property and the status quo will be maintained.
