The Bombay High Court has made a serious comment while hearing a PIL related to noise pollution from a DJ. The High Court said that while DJs of Ganpati festival can be harmful, why not DJs of Eid Miladunnavi processions. The court said that the effect of the DJ would be in the Ganpati festival, in other events as well. A division bench of Chief Justice DK Upadhyay and Justice Amit Borkar made this observation. The petitioners, in their respective PILs, sought relief by underlining the damage caused by loud noise.
In which the petitioner requested the court to issue an order keeping in mind that neither the municipal bodies nor the police can allow the use of high decibel sound devices. Let us tell you that the Bombay High Court had issued an order last month which clearly said that agencies will immediately confiscate loudspeakers and other sound systems at festivals where noise pollution rules, 2000 are violated. Referring to this order, the Division Bench observed.
DJ is not mentioned in Quran hadith
He said, when the DJ’s sound can harm people in the Ganpati festival, how can it be good in the Eid procession. The High Court has made it clear that no scripture, be it Hadith or Quran, mentions the use of DJ systems or laser lights for celebrations. Petitioner’s counsel Owais Pechkar, during the hearing of the case, requested that the order issued in respect of Ganpati festival should include all other festivals including Eid in which DJs are used.

However, the bench said that this is not necessary. During the hearing, while commenting on the damage caused by laser light, the court asked for scientific evidence. He said that the court cannot take any decision in this matter until the scientific evidence is presented in this regard. Said that we are not expert enough to take any decision on our own. Along with this, the court also commented on the petitioners. Said you don’t even do basic research while filing PIL.
