Murder For A Mango, Why The Supreme Court Changed The Life Sentence To 7 Years?

The Supreme Court has given an important verdict in the case of the murder of Kerry. The court commuted the life sentence to 7 years. While awarding the 7-year jail term along with fine, the Supreme Court said that this was not a case of premeditated murder, as the incident started as a fight between the children over mangoes, which unfortunately escalated when the elders of the family also got involved. This eventually led to death and a fatal attack on the father of one.

However, in a criminal appeal filed in the Supreme Court against the decision of the Allahabad High Court, a bench headed by Justice Sudhanshu Dhulia upheld the sentence of the convicts. But ordered to change the life sentence to seven years. The Supreme Court in the judgment said that the court convicts under Section 302 of the Indian Penal Code (IPC).

Murder is not predetermined – court

Justice A. in the Supreme Court bench. Amanullah was also involved. The bench said that the reason for the murder was a fight between the children over a mango. This was not predetermined. The fight was sudden and the family members were killed with involvement. Therefore, the court commuted the life sentence of all the convicts to seven years rigorous imprisonment.

This incident is from 1984. There was a dispute over mangoes in Gonda, Uttar Pradesh. The two children quarreled, but the two families also joined. A child was fatally attacked during this attack. In the FIR, it is stated that during the attack five named accused beat the deceased with sticks. The critically injured person was admitted to the district hospital. where he was declared dead.

From Session Court to SC

Later, the culprits were prosecuted for offenses under Sections 302, 147, 149, 323 of the IPC and the Additional Sessions Judge convicted all of them and sentenced them to life imprisonment. All the five accused filed an appeal in the Allahabad High Court against this decision. Two of the five convicts died while their appeals were pending in the High Court. The High Court upheld the sentence of the remaining three accused. After which the accused approached the Supreme Court.
